Permitting and approvals due diligence is typically done early in the process; actual permitting is often conducted after confirming the economic viability of a specific location. The process may include creating environmental impact statements; conducting environmental assessments; and preparing applications for a variety of local, state, and federal permits and approvals.

The regulatory framework, involving local, state, and federal agencies, is subject to change, especially as RTOs and general markets develop.
